FAQs

What does a Dallas personal injury lawyer handle?

Typically, we handle all types of personal injury cases including car wrecks, truck wrecks, work injuries (non-subscriber only, not Workers Compensation) and slip and falls.  Typically, there has to be some kind of negligence by another person that directly caused the injuries.  For example, if you are injured in a car wreck and the car wreck is your fault, we likely cannot help you.  But if you are not at fault or are a passenger, we can help you even if the driver of your car is at fault for the wreck.

Does a Dallas personal injury attorney defend?

We do not provide a defense. In fact, as a Dallas Trial Lawyer, I have sworn not to defend people who are sued in a personal injury case.

Is it worth getting a personal injury lawyer?

Absolutely.  We can help you with getting medical treatment on a letter of protection so you do not pay the bills until your case settles.  We can also get more money than you could on your own because (1) we understand how to negotiate (2) we can file a lawsuit (3) we can hopefully get your medical bills reduced to try and get you more money.  Plus, we deal with the insurance companies directly so you don’t have to.  Finally, if your case merits, we hire experts to work up your damages and address liability.  These experts know how to work these cases and win.

What is my pain and suffering worth?

That all depends on the extent of your injuries.  There are other damages we pursue as well such as loss of earning capacity, physical impairment, and possibly disfigurement.  We go after these damages in the past and future meaning we may have to hire experts.

How long after an injury can I file a case?

There is no limit on how soon you can file suit but you must file suit within 2 years for a personal injury case (with limited exceptions).  There may be legitimate reasons not to rush to file a suit, such as you are still undergoing treatment and you don’t know what your final status will be medically.

How is a personal injury claim calculated?

We generally look at the total value of your special damages (damages that can be reduced to paper) such as past and future medical bills, past and future loss of earning capacity, and loss of household services. Then, we take those amounts and add the expected amount for non-economic damages such as physical pain and suffering, physical impairment, and disfigurement. Then we add those together and come up with a good settlement number for your case.

What if I have already received a settlement offer from an insurance company?

We will evaluate the settlement offer and tell you based on your case whether the offer is fair or not. We will not charge for such an evaluation.

What’s included in the free consultation?

We will either sit down with you in person or over the phone and review the facts of the accident, injuries, and the negligence of the third party. Then we will tell you whether we think we can help you with your case or not.
